Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of Social Media Automator (the "Service"), operated by Cain & Co. ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. What the Service does
The Service helps you plan, schedule, and publish content to third-party social media platforms, including Instagram and Facebook (Meta), YouTube (Google), and TikTok. You connect your own accounts on those platforms, and the Service publishes content on your behalf at your direction.
3. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. Accounts are issued by invitation, and we may decline, suspend, or remove an account at our discretion.
4. Third-party platforms
When you connect a social media account, you authorize the Service to act on your behalf through that platform's API using the permissions you grant. Your use of each platform remains governed by that platform's own terms and policies, and we are not responsible for their availability, decisions, or actions — including content moderation, rate limits, account restrictions, or removal of published posts. You may disconnect any platform at any time from the admin area, which revokes the stored authorization.
5. Your content
You retain all ownership of the images, video, captions, and other material you upload or publish ("Your Content"). You grant us a limited license to store, process, transmit, and display Your Content solely to operate the Service for you. You represent that you hold the rights necessary to publish Your Content, including rights to any music, footage, or likeness it contains.
6. Acceptable use
You agree not to use the Service to:
- publish unlawful, infringing, deceptive, or harassing content;
- violate the terms, policies, or rate limits of any connected platform;
- send spam or artificially inflate engagement;
- publish content on behalf of accounts you do not own or are not authorized to manage;
- attempt to gain unauthorized access to the Service or interfere with its operation.
7. Automated and AI-assisted features
The Service includes features that use automated and machine-learning systems to draft captions, describe media, and organize your library. These outputs may be inaccurate. You are responsible for reviewing anything before it is published.
8. Availability and disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that publishing will succeed, that scheduled posts will go out on time, or that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, Cain & Co. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100).
10. Termination
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the Service. Sections 5 through 9 survive termination.
11. Changes
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above. Continued use of the Service after a change constitutes acceptance.
